ServiTag Terms of Service
Acceptance by Use
By accessing, creating, administering, paying for, uploading to, submitting through, inviting users to, or otherwise using ServiTag, you agree to these Terms of Service on behalf of yourself and, when applicable, the company, agency, customer, employer, or organization for which you are acting. If you do not have authority to bind that organization, you must not create or use a workspace for that organization.
Service Description
ServiTag is a software service for equipment, asset, inspection, maintenance, checklist, signature, media, export, and recordkeeping workflows. ServiTag supports documentation and communication, but it does not operate equipment, inspect equipment for you, certify legal compliance, provide engineering services, provide legal advice, replace workplace supervision, replace manufacturer instructions, or replace any required professional, regulatory, safety, or governmental inspection.
Account Authority and Responsibility
You are responsible for all activity under your accounts, administrator and technician roles, QR flows, shared devices, and PINs. You agree to issue access only to authorized personnel, protect passwords and PINs, remove access when a person no longer needs it, and promptly notify ServiTag of suspected unauthorized access. Actions taken through your workspace may be treated as authorized actions by your organization.
Permitted Use
You may use ServiTag only for lawful internal business, maintenance, inspection, asset tracking, operational, customer-service, and recordkeeping purposes. You may not use ServiTag to submit fraudulent records, falsify inspections, conceal unsafe conditions, harass users, upload malicious content, overload systems, bypass access controls, access another agency's data, or interfere with the service.
Ownership of ServiTag Materials
ServiTag and its owners retain all rights, title, and interest in and to the software, source code, object code, platform design, product design, workflows, templates, starter checklists, template structures, interface patterns, documentation, know-how, business logic, generated improvements, processes, trade names, trademarks, service marks, logos, icons, reports, analytics structures, and related intellectual property, whether existing now or developed later. Access to a template through ServiTag grants a limited right to configure and use it within an authorized workspace; it does not transfer ownership of the template or its underlying structure.
No Copying, Duplication, or Competitive Misuse
Except as expressly allowed in writing by ServiTag, you may not copy, duplicate, clone, scrape, mirror, frame, reproduce, republish, resell, sublicense, rent, lease, distribute, commercially exploit, reverse engineer, decompile, disassemble, benchmark for competitive purposes, extract platform logic from, create derivative works from, or use ServiTag materials, screens, workflows, templates, reports, checklist structures, database structures, source code, documentation, or service design to build, train, improve, market, or support a competing or substantially similar product or service. Customer inspection records and exported operational data remain subject to your data rights, but those rights do not transfer ownership of ServiTag's software, templates, platform logic, report formats, workflows, interface design, or underlying intellectual property.
Customer Data
You retain ownership of the business data, inspection records, asset records, forms created independently and uploaded by you, uploaded files, user-submitted notes, signatures, photographs, and operational materials you submit to your workspace. You grant ServiTag a limited, non-exclusive permission to host, store, process, transmit, secure, back up, display, format, export, and otherwise use that data as needed to provide, maintain, troubleshoot, protect, and improve the service. Customer ownership of uploaded content does not include ServiTag software, platform templates, template structures, workflows, interface design, or other ServiTag materials incorporated into or used to present that content.
De-identified Analytics and Equipment Images
ServiTag may aggregate or de-identify machine usage, inspection activity, maintenance history, performance indicators, service events, and related operational information so that it is not reasonably intended to identify a person or organization. ServiTag may use that aggregated or de-identified information to analyze trends, improve features, evaluate service quality, develop reports and benchmarks, support product decisions, and create or improve services. ServiTag will not attempt to re-identify information maintained in de-identified form except as reasonably necessary to test de-identification safeguards or as required by law.
Subject to the Privacy Policy, you grant ServiTag a non-exclusive, worldwide, royalty-free license to use de-identified copies or derivatives of uploaded equipment photographs to evaluate, train, test, and improve image-recognition, machine-learning, and related product capabilities. This license does not authorize ServiTag to use your identifiable photographs in public marketing without separate permission, and it does not apply to electronic signatures.
Upload and Media Rights
Upload, media, checklist, logo, signature, and similar rights are covered by the separate Upload & Media Rights Acknowledgement. You represent that forms, photographs, signatures, text, and other materials you upload are yours or that you have sufficient permission to use them. Uploaded content must be lawful, accurate to the extent presented as a business record, work-appropriate, relevant to legitimate workplace or equipment operations, and free from malware, harassment, obscenity, unlawful discrimination, or material that violates another person's privacy, confidentiality, publicity, or intellectual-property rights. ServiTag may reject, remove, disable, or restrict access to materials that appear unauthorized, unlawful, infringing, unsafe, malicious, confidential beyond your authority to share, or otherwise unsuitable for the service.
Privacy and Security Best Efforts
ServiTag will use commercially reasonable and good-faith efforts to protect workspace data through practical access controls, private storage patterns, authentication controls, operational safeguards, and reasonable administrative practices appropriate for a small software service. No internet-connected service, shared-hosting environment, browser, device, email system, SMS system, network, or user-managed credential process can be guaranteed completely secure. You are responsible for limiting what you upload, training your users, using appropriate devices and networks, and complying with your own privacy, employment, customer, and data-retention obligations.
Confidentiality
Each party should use reasonable care to protect non-public business information received through the service. ServiTag may access workspace information when reasonably needed to provide support, debug issues, investigate abuse, maintain security, comply with law, enforce these terms, or operate the service.
Safety, Compliance, and Field Decisions
ServiTag does not guarantee that any asset is safe, compliant, fit for use, properly maintained, legally certified, properly repaired, or ready for operation. Inspection forms, pass/fail indicators, out-of-service flags, signatures, dashboards, exports, fleet intelligence, reminders, and records are workflow aids only. You remain solely responsible for equipment safety, regulatory compliance, operator training, competent inspections, lockout/tagout procedures, manufacturer instructions, workplace policies, repairs, maintenance decisions, customer communication, and any decision to use, remove, return, certify, rent, move, or operate equipment.
Accuracy of Records
You are responsible for the truth, completeness, legality, and accuracy of all records submitted by your users. ServiTag may preserve timestamps, user identifiers, PIN context, IP information, audit records, and related metadata, but it cannot guarantee that a person entered truthful information, used the correct device, performed the physical inspection correctly, or had authority beyond what your organization assigned.
Exports, Reports, and Analytics
Exports, reports, dashboards, and analytics are provided for convenience and internal business use. They may contain user-entered errors, incomplete records, delayed data, browser display issues, or limitations based on the information available. You are responsible for independently verifying any report before relying on it for safety, legal, financial, employment, customer, regulatory, or insurance purposes.
Third-Party Services
ServiTag may integrate with or depend on third-party services such as payment processors, hosting providers, email systems, SMS systems, browsers, device cameras, storage services, mapping tools, or calendar/contact integrations. ServiTag is not responsible for outages, errors, fees, policies, security incidents, data handling, delivery failures, or changes caused by third-party services.
Availability and Changes
ServiTag may be updated, modified, suspended, limited, or discontinued in whole or in part. Beta, preview, field-trial, demo, and early-access features may be incomplete, changed without notice, unavailable, inaccurate, or removed. ServiTag does not guarantee uninterrupted access, permanent storage, or compatibility with every browser, device, hosting condition, workflow, or business process.
Payment, Subscription, and Access
Implementation and training fees, subscription fees, asset allowances, storage, exports, integrations, features, and account limits may be controlled by the applicable order, published offer, account configuration, or plan terms. Unless an offer expressly states otherwise, fees are non-refundable to the fullest extent permitted by law. Failure to pay, chargebacks, abuse, suspected fraud, or violation of these terms may result in suspension, limitation, or termination of access.
No Warranty
ServiTag is provided "as is" and "as available" to the fullest extent permitted by law. ServiTag disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, uninterrupted operation, data integrity, compliance suitability, safety suitability, and error-free performance.
Limitation of Liability
To the fullest extent permitted by law, ServiTag and its owners, operators, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-data, business-interruption, equipment-damage, downtime, safety, injury, regulatory, employment, customer, insurance, or legal damages arising from or related to the service, even if advised of the possibility of such damages. To the fullest extent permitted by law, ServiTag's total liability for any claim will not exceed the amount paid by you to ServiTag for the service during the three months before the event giving rise to the claim, or one hundred dollars if no amount was paid.
Indemnification
You agree to defend, indemnify, and hold harmless ServiTag and its owners, operators, contractors, service providers, and affiliates from claims, losses, damages, liabilities, penalties, costs, and expenses, including reasonable attorney fees, arising from your data, uploaded materials, unauthorized use, violation of these terms, violation of law, workplace incident, equipment decision, user misconduct, customer dispute, privacy issue, intellectual property claim, or misuse of the service.
No Mandatory Arbitration
Unless ServiTag and you later sign a separate written agreement requiring arbitration, disputes are not subject to mandatory arbitration under these terms. Claims may be brought in a court of competent jurisdiction, subject to any venue, jurisdiction, or governing-law requirements that apply to the parties and the dispute.
Governing Law and General Terms
Except where applicable law requires otherwise, these terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any claim that may be brought in court must be brought in a court of competent jurisdiction in Washington. If a provision of these terms is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these terms or transfer workspace access as part of a sale or reorganization without ServiTag's written consent; ServiTag may assign these terms in connection with a merger, financing, reorganization, sale of assets, or operation by an affiliate or successor.
Events Beyond Reasonable Control
ServiTag is not responsible for delay or failure caused by events beyond its reasonable control, including internet or utility failures, hosting or communications outages, labor disputes, natural disasters, acts of government, cyberattacks, widespread software defects, public emergencies, or failures of third-party services.
Termination and Data Handling
ServiTag may suspend or terminate access for nonpayment, security risk, suspected abuse, unauthorized use, legal risk, or violation of these terms. After termination, data may be retained, exported, deleted, archived, or restricted according to operational needs, legal obligations, backup cycles, and account status. You are responsible for maintaining your own required records and exports.
Updates to Terms
ServiTag may update these terms from time to time. Continued use after updated terms are posted or presented for acceptance constitutes acceptance of the updated terms. Material changes may require a renewed acknowledgement inside the service.
